US citizens and green card holders living in India, H-1B/L-1 workers with Indian income or assets, returning NRIs with US brokerage or retirement accounts, and Indian residents with US-source income such as rent, dividends or business income.
Yes. We prepare Form 1040 with W-2 wages, 1099 interest/dividends/brokerage income, and foreign (Indian) income with the foreign tax credit via Form 1116 or the foreign earned income exclusion where applicable.
FBAR (FinCEN 114) reports foreign bank/financial accounts when their combined value exceeds $10,000 at any time in the year. FATCA (Form 8938) is a similar disclosure filed with the 1040 at higher thresholds. Indian NRE/NRO accounts, mutual funds and insurance policies commonly trigger both.
Usually the US taxes the US-source income first (often via withholding), and India taxes your worldwide income with credit for the US tax under the DTAA. The correct treaty article depends on the income type — we analyse and document the claim.
The India–US treaty allocates taxing rights and both countries give a foreign tax credit for tax paid to the other. On the Indian side this requires Form 67; on the US side, Form 1116. We coordinate both filings so the credits match.
