Effective date: 3 September 2026
These Terms & Conditions (“Terms”) govern access to and use of TaxClear.in and services offered through the website by M/s. SHUBHAM PANKAJ & CO (“TaxClear”, “we”, “us” or “our”). By using the website or requesting a service, you agree to these Terms.
Service-specific terms: A written proposal, engagement letter, invoice, checkout notice or other confirmed service terms may contain additional conditions. If there is a conflict, the specific engagement terms will apply to that service.
1. About TaxClear
TaxClear.in provides tax, GST, accounting, compliance, NRI-taxation, notice-response and related professional support. The website also publishes educational articles and provides free calculators and tools. Availability and scope may vary according to the facts, documents, applicable law and separately agreed engagement.
2. Informational Content Is Not an Engagement
Articles, FAQs, examples, calculators and general responses on this website are for general informational purposes. They do not create a client-professional relationship and are not a substitute for advice based on your complete facts and current law.
A professional engagement begins only when TaxClear accepts the requested scope through an appropriate written confirmation, proposal, invoice, payment acknowledgement or engagement communication.
3. Eligibility and Authority
- You must have legal capacity to use the website and request services.
- If acting for another person or entity, you confirm that you have appropriate authority to provide instructions and information.
- A parent or lawful guardian must act where a service lawfully concerns a minor.
- We may request identity, authority or engagement verification before accepting or continuing work.
4. Your Responsibilities
- Provide complete, accurate and timely information and promptly correct anything that becomes inaccurate.
- Review drafts, calculations, return data, challans and acknowledgements when requested.
- Meet payment, document, verification, e-filing and statutory deadlines communicated to you.
- Keep passwords and OTPs confidential and complete verification only through an approved process.
- Maintain original records and supporting documents unless a written engagement specifically states otherwise.
- Do not provide forged, misleading, unlawfully obtained or unauthorised information.
TaxClear may rely on information supplied by you or your authorised representative unless verification is included in the agreed scope.
5. Scope, Deliverables and Timelines
The scope, deliverables, assumptions, fee and expected timeline for a paid service may be stated in a proposal, engagement communication, invoice or checkout page. Work outside that scope may require additional information, time and fees.
Timelines are estimates unless expressly agreed otherwise. They may be affected by delayed documents, user verification, payment confirmation, changes in law, government-portal availability, departmental processing or events outside reasonable control.
6. Fees, Taxes and Third-Party Charges
- Professional fees and applicable taxes will be communicated for the relevant service.
- Government fees, stamp duty, tax, interest, penalties, filing charges and third-party costs are separate unless expressly included.
- TaxClear may pause work where agreed fees or required third-party charges remain unpaid.
- A payment does not guarantee a refund, approval, registration, assessment outcome or decision by any government authority.
7. Cancellation and Refunds
Any cancellation or refund terms stated in the applicable proposal, engagement communication, invoice or checkout notice will govern the service. Government charges and third-party costs are controlled by the relevant authority or provider and may not be refundable by TaxClear.
If no specific cancellation term was provided, contact us promptly at casgpj@gmail.com. Eligibility will be assessed fairly with reference to work already performed, resources committed, third-party costs and applicable consumer law. Nothing in these Terms removes a refund or remedy that must be provided under applicable law.
8. Free Calculators and Tools
TaxClear calculators provide estimates based on the inputs and assumptions displayed. Results may be affected by residential status, entity type, dates, thresholds, surcharge, cess, exemptions, treaty provisions, amendments and facts not captured by the tool.
You should independently verify a result before filing a return, paying tax, entering into a transaction or making a financial or legal decision. Free tools are not filing software and do not submit information to a government portal unless expressly stated.
9. No Guarantee of Government or Financial Outcome
TaxClear will provide the agreed service with reasonable professional care. However, no outcome controlled by a tax authority, GST authority, registrar, bank, payment provider, court or other third party can be guaranteed. Processing times, notices, refunds, registrations, certificates and assessments remain subject to applicable law and the relevant authority.
10. Website Availability and Accuracy
We aim to keep website information useful and current, but laws, forms, rates, deadlines and portal procedures may change. We do not promise that every page, calculator or external link will always be complete, error-free or continuously available. We may correct, update, suspend or remove website content when reasonably necessary.
11. Acceptable Use
You must not:
- Use the website for fraud, impersonation, unlawful filing or infringement of another person’s rights.
- Attempt to gain unauthorised access, disrupt security, introduce malicious code or overload the website.
- Scrape, reproduce or commercially exploit substantial website content without permission, except as permitted by law.
- Submit information you are not authorised to disclose.
- Misrepresent a calculator result, article or TaxClear communication as a government approval or official ruling.
12. Intellectual Property
Unless otherwise stated, the TaxClear name, website design, original articles, calculators, graphics and other original website materials are owned by or licensed to TaxClear. You may use publicly available articles for personal reference and share their original links. Other copying, modification, republication or commercial exploitation requires permission unless allowed by law.
13. Third-Party Websites and Services
Links to government portals, payment services and other third-party websites are provided for convenience or service delivery. Third parties operate under their own terms, privacy notices and availability standards. TaxClear is not responsible for an external website merely because it is linked from this website.
14. Privacy and Confidential Information
Personal data is handled in accordance with our Privacy Policy. Service information may also be subject to applicable professional or contractual confidentiality obligations. You should use the secure submission method specified for sensitive documents and avoid sending passwords or OTPs.
15. Limitation of Liability
To the maximum extent permitted by applicable law, TaxClear will not be liable for indirect, incidental, special or consequential loss arising solely from website use, reliance on general informational content, inaccurate or delayed information supplied by the user, or interruption of a third-party or government system.
Nothing in these Terms excludes liability that cannot lawfully be excluded, limits mandatory consumer rights, or excuses TaxClear from responsibility for an agreed professional service under applicable law and the specific engagement terms.
16. Suspension or Refusal of Service
We may refuse, pause or end a service where instructions appear unlawful or misleading, required information or authority is missing, fees remain unpaid, a conflict or professional restriction arises, or continuing would create legal, security or ethical risk. Where reasonably possible, we will communicate the reason and any outstanding deliverables or records.
17. Governing Law and Disputes
These Terms are governed by the laws of India. The parties should first attempt to resolve a concern through good-faith communication. Any unresolved dispute will be subject to the courts or dispute-resolution forum having jurisdiction under applicable law. Mandatory consumer remedies remain unaffected.
18. Changes to These Terms
We may update these Terms when services, technology or law changes. The revised effective date will appear at the top. Changes apply prospectively from publication unless applicable law or a specific engagement requires otherwise.
