Cancellation of GST registration does not automatically complete your GST compliance. If you are required to file GSTR-10, you must submit this final return and settle the applicable liability.

The ordinary deadline is within three months of the effective cancellation date or the cancellation-order date, whichever is later. Do not calculate it only from the cancellation-application date.

Who Must File GSTR-10?

GSTR-10 generally applies to regular taxpayers whose GST registration has been cancelled, whether voluntarily or by the department.

The ordinary requirement excludes:

  • Input Service Distributors;
  • Non-resident taxable persons;
  • Composition taxpayers paying tax under Section 10;
  • Persons registered for TDS under Section 51;
  • Persons registered for TCS under Section 52.

If your registration category changed, check the periods and obligations separately.

GSTR-10 is a final return following cancellation. It is different from GSTR-9, the annual return. Filing one does not automatically replace the other.

How to Calculate the Three-Month Deadline

Check the cancellation order, generally issued in Form GST REG-19, for both relevant dates.

Detail Example
Effective date of cancellation September 30, 2026
Date of cancellation order October 20, 2026
Later date used to calculate the deadline October 20, 2026
Ordinary GSTR-10 deadline January 20, 2027

Three months is not necessarily 90 days. Compare the portal’s displayed due date with the cancellation order and applicable law.

Historical extensions or amnesty schemes do not automatically apply to a cancellation in 2026. Any relief must cover your filing circumstances.

What Stock Liability Must Be Paid?

Section 29(5) requires a review of goods held on the day immediately before the effective cancellation date.

Relevant items include:

  • Inputs held in stock;
  • Inputs contained in semi-finished goods;
  • Inputs contained in finished goods;
  • Capital goods or plant and machinery.

The liability generally involves comparing the input tax credit attributable to those goods, calculated as prescribed, with the output tax payable on them. The higher amount applies.

For capital goods, the credit calculation must account for the prescribed reduction or remaining useful life. Do not simply use the accounting book value without checking the GST calculation.

Example

Suppose the prescribed ITC amount attributable to a category of closing stock is ₹18,000, while the output tax payable on those goods is ₹21,000.

If the figures have been correctly calculated under the relevant rules, the comparison produces a liability of ₹21,000. This is a payment calculation, not a fresh ITC claim.

Calculate the amounts separately under the applicable tax heads.

What If Purchase Invoices Are Missing?

Missing invoices do not automatically remove the liability.

Where relevant input invoices are unavailable, Rule 44 provides a valuation-based method. The applicable details may require certification by a practising chartered accountant or cost accountant.

Keep valuation workings and supporting records. Do not enter zero merely because an invoice cannot be found.

Records to Prepare Before Filing

Keep these available:

  • Cancellation application and cancellation order;
  • Stock statement for the relevant date;
  • Purchase invoices and bills of entry;
  • Capital-asset register and original ITC details;
  • Stock valuation and liability calculations;
  • Details of amounts already paid during cancellation;
  • Electronic cash and credit ledger balances;
  • Pending-return information;
  • Address and contact details for future correspondence;
  • Professional certificate, where required.

Reconcile amounts already paid so that the same liability is not discharged twice. TaxClear’s accounting services can help organise the underlying records.

How to File GSTR-10 on the GST Portal

  1. Log in to the GST Portal.
  2. Go to Services → Returns → Final Return.
  3. Open GSTR-10 and verify the cancellation particulars.
  4. Update the address for future correspondence.
  5. Enter the applicable goods details, including records with and without invoices.
  6. Add professional-certification details where required.
  7. Preview the draft and reconcile the liability.
  8. Complete payment and liability set-off.
  9. File using the permitted DSC or EVC.
  10. Download the filed return and retain the ARN.

Pending applicable periodic returns can prevent GSTR-10 from being enabled. Complete outstanding filings and resolve validation issues promptly.

Eligible electronic credit may be used towards the permitted tax liability. Interest and late fees must be paid through the electronic cash ledger.

A saved draft, payment challan or preview PDF is not a filed return. Confirm that the status shows “Filed.”

Late Fees and Other Consequences

The ordinary statutory late fee is ₹100 per day under CGST, capped at ₹5,000. Corresponding SGST/UTGST late fees generally bring the combined amount to ₹200 per day, capped at ₹10,000, subject to applicable notifications.

Do not automatically apply reduced GSTR-1 or GSTR-3B late-fee rates to GSTR-10.

Non-filing can also lead to notices and assessment proceedings. Cancellation does not erase earlier tax dues, interest or other liabilities.
