What is Form 67?

Form 67 is an online statement used by eligible Indian residents to claim credit for qualifying tax paid or deducted outside India. Filing the form supports a foreign tax credit claim, but does not guarantee that credit will be allowed.

AY 2026-27 covers income earned from 1 April 2025 to 31 March 2026. The Income-tax Act, 1961 and Rule 128 of the Income-tax Rules, 1962 apply to this assessment year.

Who can claim foreign tax credit?

A resident taxpayer may be eligible if foreign tax was paid on income that is also offered to tax or assessed in India. Relief may be available under an applicable tax treaty under Section 90 or 90A, or under Section 91 where there is no applicable agreement.

Treaty relief depends on the countries and type of income involved. Foreign tax withheld is not automatically creditable in India. The tax must qualify under Indian rules and any applicable treaty.

Form 67 supports the credit claim. Foreign income is generally reported in Schedule FSI and the relief claim summarised in Schedule TR. If applicable, foreign assets are reported separately in Schedule FA; Form 67 does not replace that disclosure.

How much credit can you claim?

The credit is generally calculated separately for each source of income in each country. It is limited to the lower of the qualifying foreign tax paid and the Indian tax payable on the corresponding income. A treaty may further limit the amount of foreign tax that can be credited.

Item Treatment
Foreign tax paid or deducted May qualify if it meets Indian rules and treaty conditions
Indian tax on the corresponding income Limits the credit
Interest, fee or penalty payable in India Cannot be offset by foreign tax credit
Disputed foreign tax Special rules apply; it is not an ordinary paid-tax claim

Convert the foreign tax into rupees using the telegraphic transfer buying rate on the last day of the month immediately before the month in which the tax was paid or deducted. Keep the calculation with your records.

Form 67 deadline for AY 2026-27

Rule 128(9) states that Form 67 and the required tax evidence must be furnished by the end of the assessment year if the return is filed under Section 139(1) or 139(4). For AY 2026-27, the end of the assessment year is 31 March 2027. For an updated return under Section 139(8A), the form and related evidence must be furnished by the date the updated return is filed.

The Income Tax Department’s Form 67 FAQ and user manual, as well as AY 2026-27 return-validation guidance, also refer to filing by the due date under Section 139(1). To reduce the risk of portal validation issues, file Form 67 by your applicable ITR due date if possible. If that date has passed, check the current portal instructions before relying on the Rule 128 end-of-year window.

Documents and filing steps

Keep foreign income and tax records ready, including:

  • A statement or certificate from the foreign tax authority or the person who deducted the tax;
  • Foreign income statements and supporting calculations;
  • Bank proof, challans or receipts for tax paid; and
  • Treaty-relief documents, if applicable.

A taxpayer-signed statement may be used under Rule 128 if it is accompanied by proof of tax payment or deduction. A disputed foreign tax claim is subject to separate conditions.

Frequently asked questions

Is Form 67 required to claim foreign tax credit?

Yes. The Income Tax Department requires Form 67 and supporting evidence for a foreign tax credit claim.

Does Form 67 replace Schedule FSI or Schedule TR?

No. Report foreign income in the relevant ITR schedule and summarise the relief claim in Schedule TR. Form 67 supports the credit claim.

Can I claim credit for all tax withheld abroad?

Not automatically. The foreign tax must meet Rule 128 and any applicable treaty conditions. The credit is also limited by the Indian tax payable on the corresponding income.

Do I need a CA certificate to file Form 67?

The Department’s FAQ says a CA certificate is not required. You still need the required tax statements or proof of payment or deduction.

What if I file Form 67 after the Section 139(1) due date?

Rule 128(9) provides an end-of-assessment-year timeline for returns filed under Section 139(1) or 139(4), while portal guidance and AY 2026-27 validation instructions refer to the Section 139(1) due date. Check the portal’s current treatment before relying on a later filing date.
