In this guide
A defective return notice under Section 139(9) means the Income Tax Department has identified incomplete or inconsistent information in your income tax return. It does not necessarily mean that you have to pay more tax.
For AY 2026-27, the notice relates to income earned during FY 2025-26. These returns continue to be governed by the Income-tax Act, 1961, including the defective-return procedure.
Read the defect carefully and respond within the time limit. Failure to resolve it may result in your return being treated as invalid.
What Makes an ITR Defective?
The notice should state the defect that needs correction. Common problems include:
| Possible defect | What to check |
|---|---|
| TDS credit claimed without reporting the corresponding income | Match income and TDS with Form 16, Form 16A and Form 26AS |
| Receipts reported in the return do not match tax-credit records | Reconcile receipts under the appropriate income heads |
| Required business financial information is missing | Review the applicable balance-sheet and profit-and-loss schedules |
| Inconsistent income or tax figures | Review the complete return and tax calculation |
| Incorrect personal information | Check the return against PAN-linked details |
Not all differences justify changing your reported figures. Check your records before agreeing with the notice.
If the defect concerns form selection, refer to TaxClear’s ITR form selection guide for AY 2026-27.
How Much Time Do You Have?
The department’s portal guidance ordinarily allows 15 days from receiving the notice, or the period specified in it. Check the response deadline displayed against your proceeding.
If you need more time, request an extension through the available portal facility before the deadline. Approval is not automatic.
If the deadline has passed, act immediately. Where the defect is corrected after the permitted period but before assessment, the Assessing Officer may condone the delay and treat the return as valid. This is discretionary.
A Section 139(9) notice is different from a proposed adjustment under Section 143(1)(a). Do not assume their response periods or procedures are the same.
Records to Keep Ready
Collect:
- The notice, reference details and response deadline;
- Your filed ITR, acknowledgement and original computation;
- Form 16, Form 16A, Form 26AS and relevant AIS information;
- Records of income, deductions and tax payments;
- Books of account and financial statements, where applicable;
- Supporting documents explaining any disputed mismatch.
Check the figures before preparing a response. TaxClear’s guide to books of accounts in ITR-3 explains when financial details are required.
How to Respond on the Income Tax Portal
1. Open the Notice
Sign in to the Income Tax e-Filing Portal and go to Pending Actions → e-Proceedings.
Open the relevant defective-return proceeding and download the notice. Verify that it relates to AY 2026-27 and your filed return.
2. Decide Whether You Agree
Click Submit Response and review the options.
If you agree, correct the identified defect. If you disagree, explain why, using your records. Do not agree merely to close the proceeding.
3. Prepare the Corrected Return
Recalculate all affected schedules using the appropriate utility for AY 2026-27.
For example, if you claimed TDS on freelance receipts but omitted the corresponding income, report that income under the correct head and review related expenses and tax calculations. Simply deleting the TDS claim will not correct the underlying omission.
For an ordinary defective-return response, follow the utility’s Section 139(9) instructions and provide the notice details where required. Notices concerning updated returns have separate instructions.
4. Submit the Response
Where you agree with the defect, the portal’s response process provides for uploading the corrected return JSON. Follow the mode and requirements available for your notice.
If you disagree, submit your reasons through the response facility.
Review everything before submitting. The portal guidance states that a submitted response cannot be updated or withdrawn.
5. Save the Acknowledgement
Keep the transaction ID, confirmation and a copy of your response. Use View Response to check what was filed and monitor further communications.
Submission does not itself confirm that the department has accepted the correction.
Do You Need a Revised Return?
A revised return and a response to a defective-return notice are different procedures.
The department’s guidance allows a fresh or revised return where the applicable filing window remains open. An updated return is a separate legal category and should not be confused with a revised return.
Do not assume that filing another return automatically closes the notice. Check the proceeding and complete the required response. If the fresh or revised-return filing window has expired, use the defective-notice response process.
What Happens if You Do Not Respond?
An unresolved defect can result in the return being treated as invalid, as though it had not been filed.
Depending on your circumstances, this can affect refund processing, loss carry-forward and other tax benefits, and may lead to interest, penalties or other consequences.

Frequently Asked Questions
Does a defective-return notice mean scrutiny?
Not necessarily. It identifies a defect requiring correction or explanation; it does not automatically mean that a scrutiny assessment has begun.
Can I disagree with the notice?
Yes. Explain why the return is correct and retain supporting records.
Can I get more than 15 days?
You can request an extension, but approval is not guaranteed.
Will responding immediately release my refund?
Not necessarily. The correction must be processed, and other refund checks may remain outstanding.
Can I edit my response after submitting it?
The portal guidance says a submitted response cannot be updated or withdrawn. Review the corrected return and explanation carefully before submission.
